Denmark has provisions in its legislation relating to the granting of compulsory licences.
These can be found in The Danish Patents Act Chapter VI (Sections 45-50).
According to Section 49 Patents Act (the “general criteria”), a compulsory licence may be granted only if
1. it has not been possible to obtain a licence through agreement on reasonable terms and
2. the licensee is considered capable of exploiting the invention in a proper and reasonable manner and in compliance with the licence.
